حَدَّثَنَا هَنَّادٌ حَدَّثَنَا جَرِيرٌ عَنْ مُغِيرَةَ عَنْ الشَّعْبِيِّ قَالَ قَالَتْ فَاطِمَةُ بِنْتُ قَيْسٍطَلَّقَنِي زَوْجِي ثَلَاثًا عَلَى عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَا سُكْنَى لَكِ وَلَا نَفَقَةَقَالَ مُغِيرَةُ فَذَكَرْتُهُ لِإِبْرَاهِيمَ فَقَالَ قَالَ عُمَرُ لَا نَدَعُ كِتَابَ اللَّهِ وَسُنَّةَ نَبِيِّنَا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِقَوْلِ امْرَأَةٍ لَا نَدْرِي أَحَفِظَتْ أَمْ نَسِيَتْ وَكَانَ عُمَرُ يَجْعَلُ لَهَا السُّكْنَى وَالنَّفَقَةَ حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ حَدَّثَنَا هُشَيْمٌ أَنْبَأَنَا حُصَيْنٌ وَإِسْمَعِيلُ وَمُجَالِدٌ قَالَ هُشَيْمٌ وَحَدَّثَنَا دَاوُدُ أَيْضًا عَنْ الشَّعْبِيِّ قَالَ دَخَلْتُ عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ فَسَأَلْتُهَا عَنْ قَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِيهَا فَقَالَتْ طَلَّقَهَا زَوْجُهَا الْبَتَّةَ فَخَاصَمَتْهُ فِي السُّكْنَى وَالنَّفَقَةِ فَلَمْ يَجْعَلْ لَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سُكْنَى وَلَا نَفَقَةً وَفِي حَدِيثِ دَاوُدَ قَالَتْ وَأَمَرَنِي أَنْ أَعْتَدَّ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَهُوَ قَوْلُ بَعْضِ أَهْلِ الْعِلْمِ مِنْهُمْ الْحَسَنُ الْبَصْرِيُّ وَعَطَاءُ بْنُ أَبِي رَبَاحٍ وَالشَّعْبِيُّ وَبِهِ يَقُولُ أَحْمَدُ وَإِسْحَقُ وَقَالُوا لَيْسَ لِلْمُطَلَّقَةِ سُكْنَى وَلَا نَفَقَةٌ إِذَا لَمْ يَمْلِكْ زَوْجُهَا الرَّجْعَةَ و قَالَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْهُمْ عُمَرُ وَعَبْدُ اللَّهِ إِنَّ الْمُطَلَّقَةَ ثَلَاثًا لَهَا السُّكْنَى وَالنَّفَقَةُ وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَأَهْلِ الْكُوفَةِ و قَالَ بَعْضُ أَهْلِ الْعِلْمِ لَهَا السُّكْنَى وَلَا نَفَقَةَ لَهَا وَهُوَ قَوْلُ مَالِكِ بْنِ أَنَسٍ وَاللَّيْثِ بْنِ سَعْدٍ وَالشَّافِعِيِّ و قَالَ الشَّافِعِيُّ إِنَّمَا جَعَلْنَا لَهَا السُّكْنَى بِكِتَابِ اللَّهِ قَالَ اللَّهُ تَعَالَى{ لَا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَلَا يَخْرُجْنَ إِلَّا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ }قَالُوا هُوَ الْبَذَاءُ أَنْ تَبْذُوَ عَلَى أَهْلِهَا وَاعْتَلَّ بِأَنَّ فَاطِمَةَ بِنْتَ قَيْسٍ لَمْ يَجْعَلْ لَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ السُّكْنَى لِمَا كَانَتْ تَبْذُو عَلَى أَهْلِهَا قَالَ الشَّافِعِيُّ وَلَا نَفَقَةَ لَهَا لِحَدِيثِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي قِصَّةِ حَدِيثِ فَاطِمَةَ بِنْتِ قَيْسٍ

Narrated to us [Hannad] from [Jarir] from [Mughirah] from [Asy Sya'bi], he said: [Fathimah binti Qais] said: 'My husband divorced me thrice during the Prophet's time, peace and blessings be upon him. The Messenger of Allah, peace and blessings be upon him, said: No housing or maintenance."' Mughirah: 'I told Ibrahim he said: Umar said: "We will not abandon Allah's Book and our Prophet's sunnah for a woman's word—we do not know if she remembers or forgot." Umar gave housing and maintenance to thrice-divorced.' Narrated to us [Ahmad bin Mani'], narrated to us [Husyaim], informed us [Hushain], [Isma'il], and [Mujalid] [Husyaim] said: and narrated to us [Daud] also from [Asy Sya'bi], he said: 'I visited [Fathimah binti Qais]. I asked about the Prophet's ruling, peace and blessings be upon him. She said her husband divorced thrice she complained about housing and maintenance. The Prophet, peace and blessings be upon him, did not rule for them.' In Daud's: Fathimah said: 'He ordered iddah at Ibnu Umi Maktum's.' Abu Isa said: 'This is a hasan sahih hadith. This is some scholars' opinion: Al Hasan Al Bashri, 'Atha bin Abu Rabah, Asy Sya'bi. Also Ahmad and Ishaq: no housing or maintenance if no rujuk right. Some companions like Umar and Abdullah: housing and maintenance for thrice-divorced. This is Malik bin Anas, Laits bin Sa'ad, Syafi'i's also Sufyan Ats Tsauri and Kufans'. Others: housing but no maintenance. This is also Malik, Laits, Syafi'i's. Syafi'i: 'We establish housing by Allah's Book: "..Do not expel them from their homes nor let them leave unless they commit clear immorality.." Al Badza means harsh words to husband Fathimah not given because she spoke harshly. Syafi'i: no maintenance by the Prophet's hadith on Fathimah binti Qais.'"
