حَدَّثَنَا يَحْيَى بْنُ يَحْيَى وَأَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ كِلَاهُمَا عَنْ أَبِي مُعَاوِيَةَ قَالَ يَحْيَى أَخْبَرَنَا أَبُو مُعَاوِيَةَ عَنْ الْأَعْمَشِ عَنْ عَبْدِ اللَّهِ بْنِ مُرَّةَ عَنْ الْبَرَاءِ بْنِ عَازِبٍ قَالَ مُرَّ عَلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِيَهُودِيٍّ مُحَمَّمًا مَجْلُودًا فَدَعَاهُمْ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ هَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ قَالُوا نَعَمْ فَدَعَا رَجُلًا مِنْ عُلَمَائِهِمْ فَقَالَ أَنْشُدُكَ بِاللَّهِ الَّذِي أَنْزَلَ التَّوْرَاةَ عَلَى مُوسَى أَهَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ قَالَ لَا وَلَوْلَا أَنَّكَ نَشَدْتَنِي بِهَذَا لَمْ أُخْبِرْكَ نَجِدُهُ الرَّجْمَ وَلَكِنَّهُ كَثُرَ فِي أَشْرَافِنَا فَكُنَّا إِذَا أَخَذْنَا الشَّرِيفَ تَرَكْنَاهُ وَإِذَا أَخَذْنَا الضَّعِيفَ أَقَمْنَا عَلَيْهِ الْحَدَّ قُلْنَا تَعَالَوْا فَلْنَجْتَمِعْ عَلَى شَيْءٍ نُقِيمُهُ عَلَى الشَّرِيفِ وَالْوَضِيعِ فَجَعَلْنَا التَّحْمِيمَ وَالْجَلْدَ مَكَانَ الرَّجْمِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اللَّهُمَّ إِنِّي أَوَّلُ مَنْ أَحْيَا أَمْرَكَ إِذْ أَمَاتُوهُ فَأَمَرَ بِهِ فَرُجِمَ فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ { يَا أَيُّهَا الرَّسُولُ لَا يَحْزُنْكَ الَّذِينَ يُسَارِعُونَ فِي الْكُفْرِ } إِلَى قَوْلِهِ { إِنْ أُوتِيتُمْ هَذَا فَخُذُوهُ } يَقُولُ ائْتُوا مُحَمَّدًا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَإِنْ أَمَرَكُمْ بِالتَّحْمِيمِ وَالْجَلْدِ فَخُذُوهُ وَإِنْ أَفْتَاكُمْ بِالرَّجْمِ فَاحْذَرُوا فَأَنْزَلَ اللَّهُ تَعَالَى { وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمْ الْكَافِرُونَ } { وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمْ الظَّالِمُونَ } { وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمْ الْفَاسِقُونَ } فِي الْكُفَّارِ كُلُّهَا حَدَّثَنَا ابْنُ نُمَيْرٍ وَأَبُو سَعِيدٍ الْأَشَجُّ قَالَا حَدَّثَنَا وَكِيعٌ حَدَّثَنَا الْأَعْمَشُ بِهَذَا الْإِسْنَادِ نَحْوَهُ إِلَى قَوْلِهِ فَأَمَرَ بِهِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَرُجِمَ وَلَمْ يَذْكُرْ مَا بَعْدَهُ مِنْ نُزُولِ الْآيَةِ

Narrated to us [Yahya bin Yahya] and [Abu Bakar bin Abu Syaibah], both from [Abu Mu'awiyah]. [Yahya] said: Narrated to us [Abu Mu'awiyah] from [Al A'masy] from [Abdullah bin Murrah] from [Al Barra` bin 'Azib], he said, 'Once, a Jew, blackened and whipped, passed by the Prophet, peace and blessings be upon him. He called them and said, "Is this the punishment for adultery you find in your Torah?" They replied, "Yes." Then he called a man from their scholars and asked, "I urge you to swear by the name of Allah who revealed the Torah to Moses, is this how the punishment for adultery is found in your Torah?" He replied, "No, if you had not sworn me by Allah’s name, I would not have told you the truth. In the Torah, we know the punishment is stoning, but it is usually not applied to our elites. If an elite is caught, we let them go, but if a commoner is caught, we enforce the Torah’s law. We discussed and decided on a punishment to apply to both elites and commoners, so we chose blackening the body and whipping instead of stoning." After he finished speaking, the Messenger of Allah, peace and blessings be upon him, said, "O Allah, I am the first to revive Your Sunnah after they abolished this command." Then he ordered the Jew who committed adultery to be stoned, and he was stoned. Then Allah Almighty revealed the verse: "(O Messenger, do not grieve for those who hasten to disbelief—until His saying—If this is given to you, accept it)" (Qur'an, Al-Ma'idah: 41). The Jews said, "Come to Muhammad, peace and blessings be upon him. If he rules for blackening and whipping, accept it, but if he rules for stoning, beware." Then Allah Almighty revealed the verses: "(Whoever does not judge by what Allah has revealed, they are the disbelievers. Whoever does not judge by what Allah has revealed, they are the oppressors. Whoever does not judge by what Allah has revealed, they are the sinners)" (Qur'an, Al-Ma'idah: 44-47). This also applies to all disbelievers. Narrated to us [Ibnu Numair] and [Abu Sa'id Al Asyaj], both said: Narrated to us [Waki'], narrated to us [Al A'masy] with this chain up to his saying, "Then the Prophet, peace and blessings be upon him, ordered him to be stoned, and he was stoned." And he did not mention anything after that, like the revelation of the verses.
