حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ حَدَّثَنَا إِسْحَقُ بْنُ يُوسُفَ الْأَزْرَقُ عَنْ هِشَامٍ الدَّسْتُوَائِيِّ عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ عَنْ أَبِي قِلَابَةَ عَنْ ثَابِتِ بْنِ الضَّحَّاكِ قَالَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ حَلَفَ بِمِلَّةٍ غَيْرِ الْإِسْلَامِ كَاذِبًا فَهُوَ كَمَا قَالَقَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ اخْتَلَفَ أَهْلُ الْعِلْمِ فِي هَذَا إِذَا حَلَفَ الرَّجُلُ بِمِلَّةٍ سِوَى الْإِسْلَامِ فَقَالَ هُوَ يَهُودِيٌّ أَوْ نَصْرَانِيٌّ إِنْ فَعَلَ كَذَا وَكَذَا فَفَعَلَ ذَلِكَ الشَّيْءَ فَقَالَ بَعْضُهُمْ قَدْ أَتَى عَظِيمًا وَلَا كَفَّارَةَ عَلَيْهِ وَهُوَ قَوْلُ أَهْلِ الْمَدِينَةِ وَبِهِ يَقُولُ مَالِكُ بْنُ أَنَسٍ وَإِلَى هَذَا الْقَوْلِ ذَهَبَ أَبُو عُبَيْدٍ و قَالَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَالتَّابِعِينَ وَغَيْرِهِمْ عَلَيْهِ فِي ذَلِكَ الْكَفَّارَةُ وَهُوَ قَوْلُ سُفْيَانَ وَأَحْمَدَ وَإِسْحَقَ

Narrated to us [Ahmad bin Mani'] said, narrated to us [Ishaq bin Yusuf Al Azraq] from [Hisyam Ad Dastuwa`i] from [Yahya bin Abu Katsir] from [Abu Qilabah] from [Tsabit bin Adh Dhahhak], he said: 'The Messenger of Allah, peace and blessings be upon him, said: Whoever swears by a religion other than Islam falsely, he is as he says." Abu Isa said: 'This hadith is hasan sahih. The scholars differ in understanding this hadith if a man swears by a religion other than Islam, such as saying, "He is a Jew or a Christian" if he does such and such, and then he does it. Some say: "He has committed a grave act, but there is no expiation for it." This is the opinion of the scholars of Medina, followed by Malik bin Anas and Abu Ubaid. Others from the companions of the Prophet, peace and blessings be upon him, and others say there is expiation for it. This is the opinion of Sufyan, Ahmad, and Ishaq.'"
