حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الْمَلِكِ بْنِ أَبِي الشَّوَارِبِ حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ الْمُخْتَارِ عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَعَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ مِنْ غُسْلِهِ الْغُسْلُ وَمِنْ حَمْلِهِ الْوُضُوءُ يَعْنِي الْمَيِّتَقَالَ وَفِي الْبَاب عَنْ عَلِيٍّ وَعَائِشَةَ قَالَ أَبُو عِيسَى حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ وَقَدْ رُوِيَ عَنْ أَبِي هُرَيْرَةَ مَوْقُوفًا وَقَدْ اخْتَلَفَ أَهْلُ الْعِلْمِ فِي الَّذِي يُغَسِّلُ الْمَيِّتَ فَقَالَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ إِذَا غَسَّلَ مَيِّتًا فَعَلَيْهِ الْغُسْلُ و قَالَ بَعْضُهُمْ عَلَيْهِ الْوُضُوءُ و قَالَ مَالِكُ بْنُ أَنَسٍ أَسْتَحِبُّ الْغُسْلَ مِنْ غُسْلِ الْمَيِّتِ وَلَا أَرَى ذَلِكَ وَاجِبًا وَهَكَذَا قَالَ الشَّافِعِيُّ و قَالَ أَحْمَدُ مَنْ غَسَّلَ مَيِّتًا أَرْجُو أَنْ لَا يَجِبَ عَلَيْهِ الْغُسْلُ وَأَمَّا الْوُضُوءُ فَأَقَلُّ مَا قِيلَ فِيهِ و قَالَ إِسْحَقُ لَا بُدَّ مِنْ الْوُضُوءِ قَالَ وَقَدْ رُوِيَ عَنْ عَبْدِ اللَّهِ بْنِ الْمُبَارَكِ أَنَّهُ قَالَ لَا يَغْتَسِلُ وَلَا يَتَوَضَّأُ مَنْ غَسَّلَ الْمَيِّتَ

Narrated to us [Muhammad bin Abdul Malik bin Abu Asy Syawarib], narrated to us [Abdul Aziz bin Al Mukhtar] from [Suhail bin Abu Shalih] from [his father] from [Abu Hurairah] from the Prophet (peace be upon him) who said: 'After washing the deceased, he must take a bath and after carrying him he must perform ablution.' (Abu Isa At Tirmidzi) said: 'A similar Hadith is narrated from Ali and 'Aisyah.' Abu 'Isa said: 'The Hadith of Abu Hurairah is a hasan Hadith. This Hadith is also narrated from Abu Hurairah as mauquf. The scholars differ in opinion regarding the one who washes the deceased. Some of them from the companions of the Prophet (peace be upon him) and others opine: if he washes the deceased then he must take a bath. And some of them opine: He only must perform ablution. Malik bin Anas said: I prefer taking a bath after washing the deceased, but do not consider it obligatory. Likewise, the opinion of Syafi'i. Ahmad said: One who has washed the deceased, I hope he does not have to take a bath, but at least he performs ablution. Ishaq said: He must perform ablution. (Abu Isa At Tirmidzi) said: It is narrated from Abdullah bin Mubarak, he said: One who washes the deceased does not have to take a bath or perform ablution.'
