قَالَ الْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ عَنْ سُفْيَانَ عَنْ عَمْرٍو عَنْ مُجَاهِدٍ عَنْ ابْنِ عَبَّاسٍ قَالَكَانَ فِي بَنِي إِسْرَائِيلَ الْقِصَاصُ وَلَمْ تَكُنْ فِيهِمْ الدِّيَةُ فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ{ كُتِبَ عَلَيْكُمْ الْقِصَاصُ فِي الْقَتْلَى الْحُرُّ بِالْحُرِّ وَالْعَبْدُ بِالْعَبْدِ وَالْأُنْثَى بِالْأُنْثَى إِلَى قَوْلِهِ فَمَنْ عُفِيَ لَهُ مِنْ أَخِيهِ شَيْءٌ فَاتِّبَاعٌ بِالْمَعْرُوفِ وَأَدَاءٌ إِلَيْهِ بِإِحْسَانٍ }فَالْعَفْوُ أَنْ يَقْبَلَ الدِّيَةَ فِي الْعَمْدِ وَاتِّبَاعٌ بِمَعْرُوفٍ يَقُولُ يَتَّبِعُ هَذَا بِالْمَعْرُوفِ وَأَدَاءٌ إِلَيْهِ بِإِحْسَانٍ وَيُؤَدِّي هَذَا بِإِحْسَانٍ ذَلِكَ تَخْفِيفٌ مِنْ رَبِّكُمْ وَرَحْمَةٌ مِمَّا كُتِبَ عَلَى مَنْ كَانَ قَبْلَكُمْ إِنَّمَا هُوَ الْقِصَاصُ لَيْسَ الدِّيَةَ

[Al Harith bin Miskin] said by reading the history and I heard from [Sufyan] from ['Amru] from [Mujahid] from [Ibn Abbas], he said : Previously, among the Children of Israel there was a law on qishas but there was no diyat on them, then Allah the Mighty and Majestic revealed the verse: (O you who believe, qishash is enjoined on you regarding those who are killed; free people with free people, slaves with slaves, and women with women. So whoever gets forgiveness from his brother, let (the one who forgives) follow it in a good way, and let (the one who is forgiven) pay (diat) to the one who gives it. sorry in a good way (too)). Giving forgiveness is accepting diyat for intentional killing, and let (the one who forgives) follow it in a good way, and let (the one who forgives) pay (diat) to the one who forgives in a good way (also)), and carry out this with kindness. This is a relief from your Lord and a mercy from what was required of the people before you, in fact this is qishas, not diyat.
