حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ وَهَنَّادٌ قَالَا حَدَّثَنَا أَبُو مُعَاوِيَةَ عَنْ الْحَجَّاجِ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِأَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَدَّ ابْنَتَهُ زَيْنَبَ عَلَى أَبِي الْعَاصِي بْنِ الرَّبِيعِ بِمَهْرٍ جَدِيدٍ وَنِكَاحٍ جَدِيدٍقَالَ أَبُو عِيسَى هَذَا حَدِيثٌ فِي إِسْنَادِهِ مَقَالٌ وَفِي الْحَدِيثِ الْآخَرِ أَيْضًا مَقَالٌ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ أَهْلِ الْعِلْمِ أَنَّ الْمَرْأَةَ إِذَا أَسْلَمَتْ قَبْلَ زَوْجِهَا ثُمَّ أَسْلَمَ زَوْجُهَا وَهِيَ فِي الْعِدَّةِ أَنَّ زَوْجَهَا أَحَقُّ بِهَا مَا كَانَتْ فِي الْعِدَّةِ وَهُوَ قَوْلُ مَالِكِ بْنِ أَنَسٍ وَالْأَوْزَاعِيِّ وَالشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَقَ

Narrated to us [Ahmad bin Mani'] and [Hannad], they said: Narrated to us [Abu Mu'awiyah] from [Al Hajjaj] from ['Amr bin Syua'ib] from [his father] from [his grandfather] that the Messenger of Allah, peace and blessings be upon him, returned his daughter Zainab to her husband Abu Al 'Ash bin Rabi' with new dowry and marriage. Abu 'Isa said: 'There is criticism in this hadith's chain, and in another. The scholars practice this hadith: if a woman embraces Islam before her husband, then he embraces Islam while she is in iddah, he has more right to return to her. This is the opinion of Malik bin Anas, Al Auza'i, Syafi'i, Ahmad, and Ishaq.'
