حَدَّثَنَا عَبْد اللَّهِ حَدَّثَنِي أَبِي حَدَّثَنَا وَكِيعٌ حَدَّثَنَا شُعْبَةُ عَنْ أَبِي عَوْنٍ الثَّقَفِيِّ عَنِ الْحَارِثِ بْنِ عَمْرٍو عَنْ رِجَالٍ مِنْ أَصْحَابِ مُعَاذٍ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمَّا بَعَثَهُ إِلَى الْيَمَنِ فَقَالَ كَيْفَ تَقْضِي قَالَ أَقْضِي بِكِتَابِ اللَّهِ قَالَ فَإِنْ لَمْ يَكُنْ فِي كِتَابِ اللَّهِ قَالَ فَبِسُنَّةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ فَإِنْ لَمْ يَكُنْ فِي سُنَّةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ أَجْتَهِدُ رَأْيِي قَالَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْحَمْدُ لِلَّهِ الَّذِي وَفَّقَ رَسُولَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ

Narrated to us 'Abdullah has told me about my father. Narrated to us [Waki'] Narrated to us [Syu'bah] from [Abu 'Aun Ats Tsaqafi] from [Al Harith bin 'Amr] from [some of Mu'adz's companions] that the Prophet Peace be upon him said to him when he sent him to Yemen; "How do you decide things?" He answered; I judge based on Allah's book. The Prophet Peace be upon him said: "What if there is nothing in the book of Allah?" He answered; With the sunnah of the Prophet Peace be upon him. Rasulullah Sallallahu'alaihiwasallam said: "What if it is not in the sunnah of Rasulullah Sallallahu'alaihiwasallam?" He answered; I ijtihad with my opinion. Then the Prophet Peace be upon him said: "Praise be to Allah who gave help to the Messenger of Allah.
