حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ عُمَرَ بْنِ مَيْسَرَةَ وَمُحَمَّدُ بْنُ عُبَيْدٍ الْمَعْنَى قَالَا حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ بُشَيْرِ بْنِ يَسَارٍ عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ وَرَافِعِ بْنِ خَدِيجٍأَنَّ مُحَيِّصَةَ بْنَ مَسْعُودٍ وَعَبْدَ اللَّهِ بْنَ سَهْلٍ انْطَلَقَا قِبَلَ خَيْبَرَ فَتَفَرَّقَا فِي النَّخْلِ فَقُتِلَ عَبْدُ اللَّهِ بْنُ سَهْلٍ فَاتَّهَمُوا الْيَهُودَ فَجَاءَ أَخُوهُ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَابْنَا عَمِّهِ حُوَيِّصَةُ وَمُحَيِّصَةُ فَأَتَوْا النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَتَكَلَّمَ عَبْدُ الرَّحْمَنِ فِي أَمْرِ أَخِيهِ وَهُوَ أَصْغَرُهُمْ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْكُبْرَ الْكُبْرَ أَوْ قَالَ لِيَبْدَأْ الْأَكْبَرُ فَتَكَلَّمَا فِي أَمْرِ صَاحِبِهِمَا فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُقْسِمُ خَمْسُونَ مِنْكُمْ عَلَى رَجُلٍ مِنْهُمْ فَيُدْفَعُ بِرُمَّتِهِ قَالُوا أَمْرٌ لَمْ نَشْهَدْهُ كَيْفَ نَحْلِفُ قَالَ فَتُبَرِّئُكُمْ يَهُودُ بِأَيْمَانِ خَمْسِينَ مِنْهُمْ قَالُوا يَا رَسُولَ اللَّهِ قَوْمٌ كُفَّارٌ قَالَ فَوَدَاهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ قِبَلِهِقَالَ سَهْلٌ دَخَلْتُ مِرْبَدًا لَهُمْ يَوْمًا فَرَكَضَتْنِي نَاقَةٌ مِنْ تِلْكَ الْإِبِلِ رَكْضَةً بِرِجْلِهَا قَالَ حَمَّادٌ هَذَا أَوْ نَحْوَهُ قَالَ أَبُو دَاوُد رَوَاهُ بِشْرُ بْنُ الْمُفَضَّلِ وَمَالِكٌ عَنْ يَحْيَى بْنِ سَعِيدٍ قَالَ فِيهِ أَتَحْلِفُونَ خَمْسِينَ يَمِينًا وَتَسْتَحِقُّونَ دَمَ صَاحِبِكُمْ أَوْ قَاتِلِكُمْ وَلَمْ يَذْكُرْ بِشْرٌ دَمًا و قَالَ عَبْدَةُ عَنْ يَحْيَى كَمَا قَالَ حَمَّادٌ وَرَوَاهُ ابْنُ عُيَيْنَةَ عَنْ يَحْيَى فَبَدَأَ بِقَوْلِهِ تُبَرِّئُكُمْ يَهُودُ بِخَمْسِينَ يَمِينًا يَحْلِفُونَ وَلَمْ يَذْكُرْ الِاسْتِحْقَاقَ قَالَ أَبُو دَاوُد وَهَذَا وَهْمٌ مِنْ ابْنِ عُيَيْنَةَ

Narrated to us [Ubaidullah bin Umar bin Masarah] and [Muhammad bin Ubaid] in meaning, both said: Narrated to us [Hammad bin Zaid] from [Yahya bin Sa'id] from [Busyair bin Yasar] from [Sahl bin Abu Hatsmah] and [Rafi' bin Khadij], said: 'Muhayishah bin Mas'ud and Abdullah bin Sahl set out towards Khaibar, but they separated in the date palm plantation. Then Abdullah bin Sahl was killed, and they accused the Jews of having killed him. Then his brother named 'Abdurrahman bin Sahl came along with two children of his uncles, Huwayishah and Muhayishah, to the Prophet peace and blessings be upon him. Then 'Abdurrahman told about his brother - he was the smallest among his brothers -, he said: 'It should start from the elder, it should start from the elder. Or he said: 'The elder should begin.' Then both told about their killed brother, the Messenger of Allah peace and blessings be upon him said: 'Let fifty people from you swear over one of them (the Jew who killed), thereby you can redeem the brittle bones of your brother.' They replied: 'We did not see the incident directly, so how can we swear!' He said: 'The Jews will be cleared of your accusation if they can provide an oath from fifty people from their group.' The companions responded: 'They are disbelievers!' He (the narrator) said: 'Then the Messenger of Allah peace and blessings be upon him redeemed (diyat) the victim's soul with his own personal wealth.' Sahl said: 'One day I entered their camel enclosure, suddenly I was kicked by a female camel with its foot.' Hammad commented: 'This is how the hadith is, or something like this approximately.' Abu Dawud said: '[Bisyr Ibnul Mufadhdhal] and [Malik] narrated it from [Yahya bin Sa'id]. He mentioned in that hadith: 'Are you willing to swear with fifty oaths, then you are entitled to demand revenge for the killing of your companion here?' but Bisyr did not mention the word 'blood'. [Abdah] also said from [Yahya] as said by [Hammad].' [Ibnu Uyainah] also narrated from [Yahya], but he started with the sentence: 'The Jews will be cleared of your accusation if they provide fifty oaths to you, and he did not mention the phrase 'entitled'. Abu Dawud said: 'And this is the vaguenes from Ibnu Uyainah.'
