حَدَّثَنَا قُتَيْبَةُ حَدَّثَنَا اللَّيْثُ عَنْ ابْنِ شِهَابٍ عَنْ عُرْوَةَ أَنَّ عَائِشَةَ أَخْبَرَتْهُأَنَّ بَرِيرَةَ جَاءَتْ تَسْتَعِينُ عَائِشَةَ فِي كِتَابَتِهَا وَلَمْ تَكُنْ قَضَتْ مِنْ كِتَابَتِهَا شَيْئًا فَقَالَتْ لَهَا عَائِشَةُ ارْجِعِي إِلَى أَهْلِكِ فَإِنْ أَحَبُّوا أَنْ أَقْضِيَ عَنْكِ كِتَابَتَكِ وَيَكُونَ لِي وَلَاؤُكِ فَعَلْتُ فَذَكَرَتْ ذَلِكَ بَرِيرَةُ لِأَهْلِهَا فَأَبَوْا وَقَالُوا إِنْ شَاءَتْ أَنْ تَحْتَسِبَ عَلَيْكِ وَيَكُونَ لَنَا وَلَاؤُكِ فَلْتَفْعَلْ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ابْتَاعِي فَأَعْتِقِي فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ ثُمَّ قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ مَنْ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللَّهِ فَلَيْسَ لَهُ وَإِنْ اشْتَرَطَ مِائَةَ مَرَّةٍقَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ عَنْ عَائِشَةَ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ أَنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ

Narrated to us [Qutaibah] has told us [Al Laits] from [Ibnu Shihab] from ['Urwah] that ['Aisyah] informed him that Barirah had come to ask 'Aisyah for help regarding her Kitabah (agreement for her freedom by paying a certain amount of money), but Aisyah had not had time to fulfill it. Then Aisyah said to Barirah, "Go back to your master, if they are willing for me to fulfill your scriptures and your guardianship will be my right, I will definitely do it." Finally Barirah told this to her employers, but they were reluctant, saying, "If he wants, he can release you, but your guardianship remains with you." Then Aisha told the Prophet (peace and blessings of Allah be upon him), and the Prophet (peace and blessings of Allah be upon him) said: "What will happen to them if they make a condition that is not in the Qibatullah? Whoever makes a condition that is not in the Book of Allah, then that condition is meaningless to him, even if he makes a condition a hundred times." Abu Isa said: This is a Hasan Sahih hadith. And this hadith has also been narrated by more than one narrator from Aisha. According to Ahlul Imi, this hadith is practiced. Namely, guardianship is the property of the one who liberates.
