حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ عَنْ عَبْدِ اللَّهِ بْنِ عَطَاءٍ عَنْ عَبْدِ اللَّهِ بْنِ بُرَيْدَةَ عَنْ أَبِيهِ قَالَكُنْتُ جَالِسًا عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذْ أَتَتْهُ امْرَأَةٌ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي كُنْتُ تَصَدَّقْتُ عَلَى أُمِّي بِجَارِيَةٍ وَإِنَّهَا مَاتَتْ قَالَ وَجَبَ أَجْرُكِ وَرَدَّهَا عَلَيْكِ الْمِيرَاثُ قَالَتْ يَا رَسُولَ اللَّهِ إِنَّهَا كَانَ عَلَيْهَا صَوْمُ شَهْرٍ أَفَأَصُومُ عَنْهَا قَالَ صُومِي عَنْهَا قَالَتْ يَا رَسُولَ اللَّهِ إِنَّهَا لَمْ تَحُجَّ قَطُّ أَفَأَحُجُّ عَنْهَا قَالَ نَعَمْ حُجِّي عَنْهَاقَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ لَا يُعْرَفُ هَذَا مِنْ حَدِيثِ بُرَيْدَةَ إِلَّا مِنْ هَذَا الْوَجْهِ وَعَبْدُ اللَّهِ بْنُ عَطَاءٍ ثِقَةٌ عِنْدَ أَهْلِ الْحَدِيثِ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ أَنَّ الرَّجُلَ إِذَا تَصَدَّقَ بِصَدَقَةٍ ثُمَّ وَرِثَهَا حَلَّتْ لَهُ و قَالَ بَعْضُهُمْ إِنَّمَا الصَّدَقَةُ شَيْءٌ جَعَلَهَا لِلَّهِ فَإِذَا وَرِثَهَا فَيَجِبُ أَنْ يَصْرِفَهَا فِي مِثْلِهِ وَرَوَى سُفْيَانُ الثَّوْرِيُّ وَزُهَيْرٌ هَذَا الْحَدِيثَ عَنْ عَبْدِ اللَّهِ بْنِ عَطَاءٍ

Narrated to us [Ali bin Hujr], narrated to us [Ali bin Mushir] from [Abdullah bin 'Atha'] from [Abdullah bin Buraidah] from [his father], he said, when I was sitting with the Prophet, peace and blessings be upon him, a woman came saying, O Messenger of Allah, indeed I once gave charity to my mother with a female slave but she died before I gave it to her, he said: "You still get the reward and the slave becomes yours as inheritance." She (the woman) said again, O Messenger of Allah, indeed my mother still has the obligation to fast, may I fast on her behalf? He answered: "Fast for her, she asked again, O Messenger of Allah, indeed she has never performed Hajj at all, may I perform Hajj on her behalf? He answered: "Perform Hajj for her." Abu 'Isa said, this is a hasan sahih hadith, this hadith is not narrated from Buraidah except through this chain. Abdullah bin 'Atha' is a trustworthy person according to the people of hadith, and the scholars practice this hadith, namely, if someone gives charity then inherits it the ruling is permissible. Some scholars hold, Indeed charity is wealth that becomes the property of Allah if he inherits it the wealth should be spent again. [Sufyan Ats Tsauri] and [Zuhair] narrated this hadith from [Abdullah bin Atha'].
