حَدَّثَنَا هَنَّادٌ حَدَّثَنَا أَبُو مُعَاوِيَةَ عَنْ الْأَعْمَشِ عَنْ أَبِي وَائِلٍ عَنْ عَمْرِو بْنِ الْحَارِثِ بْنِ الْمُصْطَلِقِ عَنْ ابْنِ أَخِي زَيْنَبَ امْرَأَةِ عَبْدِ اللَّهِ عَنْ زَيْنَبَ امْرَأَةِ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ قَالَتْخَطَبَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ يَا مَعْشَرَ النِّسَاءِ تَصَدَّقْنَ وَلَوْ مِنْ حُلِيِّكُنَّ فَإِنَّكُنَّ أَكْثَرُ أَهْلِ جَهَنَّمَ يَوْمَ الْقِيَامَةِحَدَّثَنَا مَحْمُودُ بْنُ غَيْلَانَ حَدَّثَنَا أَبُو دَاوُدَ عَنْ شُعْبَةَ عَنْ الْأَعْمَشِ قَال سَمِعْتُ أَبَا وَائِلٍ يُحَدِّثُ عَنْ عَمْرِو بْنِ الْحَارِثِ ابْنِ أَخِي زَيْنَبَ امْرَأَةِ عَبْدِ اللَّهِ عَنْ زَيْنَبَ امْرَأَةِ عَبْدِ اللَّهِ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَهُ قَالَ أَبُو عِيسَى وَهَذَا أَصَحُّ مِنْ حَدِيثِ أَبِي مُعَاوِيَةَ وَأَبُو مُعَاوِيَةَ وَهِمَ فِي حَدِيثِهِ فَقَالَ عَنْ عَمْرِو بْنِ الْحَارِثِ عَنْ ابْنِ أَخِي زَيْنَبَ وَالصَّحِيحُ إِنَّمَا هُوَ عَنْ عَمْرِو بْنِ الْحَارِثِ إِبْنِ أَخِي زَيْنَبَ وَقَدْ رُوِيَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ رَأَى فِي الْحُلِيِّ زَكَاةً وَفِي إِسْنَادِ هَذَا الْحَدِيثِ مَقَالٌ وَاخْتَلَفَ أَهْلُ الْعِلْمِ فِي ذَلِكَ فَرَأَى بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَالتَّابِعِينَ فِي الْحُلِيِّ زَكَاةَ مَا كَانَ مِنْهُ ذَهَبٌ وَفِضَّةٌ وَبِهِ يَقُولُ سُفْيَانُ الثَّوْرِيُّ وَعَبْدُ اللَّهِ بْنُ الْمُبَارَكِ و قَالَ بَعْضُ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْهُمْ ابْنُ عُمَرَ وَعَائِشَةُ وَجَابِرُ بْنُ عَبْدِ اللَّهِ وَأَنَسُ بْنُ مَالِكٍ لَيْسَ فِي الْحُلِيِّ زَكَاةٌ وَهَكَذَا رُوِيَ عَنْ بَعْضِ فُقَهَاءِ التَّابِعِينَ وَبِهِ يَقُولُ مَالِكُ بْنُ أَنَسٍ وَالشَّافِعِيُّ وَأَحْمَدُ وَإِسْحَقُ

Narrated to us [Hannad], narrated to us [Abu Mu'awiyah] from [Al A'masy] from [Abu Wa'il] from [Amru bin Al Harits bin Mushthaliq] from [his nephew Zainab] wife of Abdullah from [Zainab] wife of Abdullah bin Mas'ud, she said: Rasululah, peace and blessings be upon him, gave a speech to the women, he said: "O women, give charity even with your jewelry, because most of the inhabitants of Jahannam hell are women." Narrated to us [Mahmud bin Ghailan], narrated to us [Abu Daud] from [Syu'bah] from [A'masy], he said, I heard [Abu Wa`il] narrate a hadith from [Amru bin Al Harits] nephew of Zainab from [Zainab] wife of Abdullah bin Mas'ud from the Prophet, peace and blessings be upon him, like the above hadith. Abu 'Isa said, this narration is more sahih than the hadith of Abu Mu'awiyah, because there is wahm (doubt) in the hadith of Abu Mu'awiyah, he narrated from Amru bin Harits from his nephew Zainab, but the correct is from Amru bin Harits nephew of Zainab. This hadith has been narrated from Amru bin Syu'aib from his father from his grandfather from the Prophet, peace and blessings be upon him, that he held the obligation of zakat on jewelry, but in the chain of this hadith there is a defect. The scholars differ, some scholars from the companions of the Prophet, peace and blessings be upon him, and tabi'in like Sufyan Ats Tsauri hold the obligation of zakat on jewelry made of gold and silver, and some companions of the Prophet, peace and blessings be upon him, like Ibnu Umar, Aisyah, Jabir bin Abdillah and Malik bin Anas and some fuqaha like Malik bin Anas, Syafi'i, Ahmad and Ishaq hold no obligation of zakat on jewelry.
