قَالَ يَحْيَى عَنْ مَالِك أَنَّهُ بَلَغَهُ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ وَغَيْرِهِ أَنَّهُمْ سُئِلُواعَنْ رَجُلٍ جُلِدَ الْحَدَّ أَتَجُوزُ شَهَادَتُهُ فَقَالُوا نَعَمْ إِذَا ظَهَرَتْ مِنْهُ التَّوْبَةُو حَدَّثَنِي مَالِك أَنَّهُ سَمِعَ ابْنَ شِهَابٍ يُسْأَلُ عَنْ ذَلِكَ فَقَالَ مِثْلَ مَا قَالَ سُلَيْمَانُ بْنُ يَسَارٍ قَالَ مَالِك وَذَلِكَ الْأَمْرُ عِنْدَنَا وَذَلِكَ لِقَوْلِ اللَّهِ تَبَارَكَ وَتَعَالَى{ وَالَّذِينَ يَرْمُونَ الْمُحْصَنَاتِ ثُمَّ لَمْ يَأْتُوا بِأَرْبَعَةِ شُهَدَاءَ فَاجْلِدُوهُمْ ثَمَانِينَ جَلْدَةً وَلَا تَقْبَلُوا لَهُمْ شَهَادَةً أَبَدًا وَأُولَئِكَ هُمْ الْفَاسِقُونَ إِلَّا الَّذِينَ تَابُوا مِنْ بَعْدِ ذَلِكَ وَأَصْلَحُوا فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌ }

Yahya said; from Malik that it had reached him, from [Sulaiman bin Yasar] and [others] that they were asked about the testimony of a person who had been flogged, whether his testimony was accepted? They answered; "Yes, if you have repented." Malik told me that he had heard [Ibnu Shihab] being asked about this, so he answered as Sulaiman bin Yasar said. Malik said; "That is our opinion, as Allah Tabaraka Wa Ta'ala says: '(And those who accuse good women (of committing adultery) and they do not bring four witnesses, then lash them (those who accuse) eighty lashes, and do not accept their testimony forever. And they are the wicked, except for those who repent afterward and reform (themselves), So indeed Allah is Forgiving, Most Merciful Merciful) ' (Qs. An Nuur: 4)
