حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ حَدَّثَنَا هُشَيْمٌ حَدَّثَنَا عَامِرٌ الْأَحْوَلُ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَا نَذْرَ لِابْنِ آدَمَ فِيمَا لَا يَمْلِكُ وَلَا عِتْقَ لَهُ فِيمَا لَا يَمْلِكُ وَلَا طَلَاقَ لَهُ فِيمَا لَا يَمْلِكُقَالَ وَفِي الْبَاب عَنْ عَلِيٍّ وَمُعَاذِ بْنِ جَبَلٍ وَجَابِرٍ وَابْنِ عَبَّاسٍ وَعَائِشَةَ قَالَ أَبُو عِيسَى حَدِيثُ عَبْدِ اللَّهِ بْنِ عَمْرٍو حَدِيثٌ حَسَنٌ صَحِيحٌ وَهُوَ أَحْسَنُ شَيْءٍ رُوِيَ فِي هَذَا الْبَابِ وَهُوَ قَوْلُ أَكْثَرِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ رُوِيَ ذَلِكَ عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ وَابْنِ عَبَّاسٍ وَجَابِرِ بْنِ عَبْدِ اللَّهِ وَسَعِيدِ بْنِ الْمُسَيَّبِ وَالْحَسَنِ وَسَعِيدِ بْنِ جُبَيْرٍ وَعَلِيِّ بْنِ الْحُسَيْنِ وَشُرَيْحٍ وَجَابِرِ بْنِ زَيْدٍ وَغَيْرِ وَاحِدٍ مِنْ فُقَهَاءِ التَّابِعِينَ وَبِهِ يَقُولُ الشَّافِعِيُّ وَرُوِيَ عَنْ ابْنِ مَسْعُودٍ أَنَّهُ قَالَ فِي الْمَنْصُوبَةِ إِنَّهَا تَطْلُقُ وَقَدْ رُوِيَ عَنْ إِبْرَاهِيمَ النَّخَعِيِّ وَالشَّعْبِيِّ وَغَيْرِهِمَا مِنْ أَهْلِ الْعِلْمِ أَنَّهُمْ قَالُوا إِذَا وَقَّتَ نُزِّلَ وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَمَالِكِ بْنِ أَنَسٍ أَنَّهُ إِذَا سَمَّى امْرَأَةً بِعَيْنِهَا أَوْ وَقَّتَ وَقْتًا أَوْ قَالَ إِنْ تَزَوَّجْتُ مِنْ كُورَةِ كَذَا فَإِنَّهُ إِنْ تَزَوَّجَ فَإِنَّهَا تَطْلُقُ وَأَمَّا ابْنُ الْمُبَارَكِ فَشَدَّدَ فِي هَذَا الْبَابِ وَقَالَ إِنْ فَعَلَ لَا أَقُولُ هِيَ حَرَامٌ و قَالَ أَحْمَدُ إِنْ تَزَوَّجَ لَا آمُرُهُ أَنْ يُفَارِقَ امْرَأَتَهُ و قَالَ إِسْحَقُ أَنَا أُجِيزُ فِي الْمَنْصُوبَةِ لِحَدِيثِ ابْنِ مَسْعُودٍ وَإِنْ تَزَوَّجَهَا لَا أَقُولُ تَحْرُمُ عَلَيْهِ امْرَأَتُهُ وَوَسَّعَ إِسْحَقُ فِي غَيْرِ الْمَنْصُوبَةِ وَذُكِرَ عَنْ عَبْدِ اللَّهِ بْنِ الْمُبَارَكِ أَنَّهُ سُئِلَ عَنْ رَجُلٍ حَلَفَ بِالطَّلَاقِ أَنَّهُ لَا يَتَزَوَّجُ ثُمَّ بَدَا لَهُ أَنْ يَتَزَوَّجَ هَلْ لَهُ رُخْصَةٌ بِأَنْ يَأْخُذَ بِقَوْلِ الْفُقَهَاءِ الَّذِينَ رَخَّصُوا فِي هَذَا فَقَالَ عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ إِنْ كَانَ يَرَى هَذَا الْقَوْلَ حَقَّا مِنْ قَبْلِ أَنْ يُبْتَلَى بِهَذِهِ الْمَسْأَلَةِ فَلَهُ أَنْ يَأْخُذَ بِقَوْلِهِمْ فَأَمَّا مَنْ لَمْ يَرْضَ بِهَذَا فَلَمَّا ابْتُلِيَ أَحَبَّ أَنْ يَأْخُذَ بِقَوْلِهِمْ فَلَا أَرَى لَهُ ذَلِكَ

Narrated to us [Ahmad bin Mani'], narrated to us [Husyaim], narrated to us [Amir Al Ahwal] from [Amru bin Syu'aib] from [his father] from [his grandfather], he said: The Messenger of Allah, peace and blessings be upon him, said: 'There is no vow for the son of Adam over what he does not own, no freeing of what he does not own, and no divorce of what he does not own.' He said: In this matter, there are similar hadiths from Ali, Mu'adz bin Jabal, Jabir, Ibnu Abbas, and A`isyah. Abu Isa said: 'The hadith of Abdullah bin Amru is a hasan sahih hadith it is the best in this chapter. This is the opinion of most scholars among the companions of the Prophet, peace and blessings be upon him, and others. Narrated from Ali bin Abu Thalib, Ibnu Abbas, Jabir bin Abdullah, Sa'id bin Al Musayyab, Al Hasan, Sa'id bin Jubair, Ali bin Al Husain, Syuraih, Jabir bin Zair, and many fuqaha tabi'in this is what Asy Syafi'i said. Narrated from Ibnu Mas'ud on al manshubah: divorce falls. Narrated from Ibrahim An Nakha'i, Asy Syafi'i, and others: if he specifies the time of marriage, divorce falls. This is Sufyan Ats Tsauri's and Malik bin Anas's opinion: one who specifies the prospective wife or marriage time, or says: If I marry a woman from this village," and he does, divorce falls. Ibnul Mubarak emphasized: if he performs the marriage, I do not hold the woman haram for him. Ahmad said: if he performs, I do not order divorcing his wife. Ishaq said: I permit marrying the specified woman based on Ibnu Mas'ud's hadith if he marries her, I do not hold his wife haram. Ishaq allows leniency in marrying unspecified women. Narrated from Abdullah bin Al Mubarak: asked about a man swearing divorce not to marry, then wanting to is there leniency to take fuqaha's permitting opinion? Ibnul Mubarak: if he held it correct before the issue, he may take it. For one disagreeing but taking it when affected, I disapprove.'"
