حَدَّثَنَا بَهْزٌ وَعَفَّانُ قَالَا حَدَّثَنَا أَبُو عَوَانَةَ عَنْ يَعْلَى بْنِ عَطَاءٍ عَنِ الْوَلِيدِ بْنِ عَبْدِ الرَّحْمَنِ عَنِ الْحَارِثِ بْنِ عَبْدِ اللَّهِ بْنِ أَوْسٍ الثَّقَفِيِّ قَالَ سَأَلْتُ عُمَرَ بْنَ الْخَطَّابِ عَنْ الْمَرْأَةِ تَطُوفُ بِالْبَيْتِ ثُمَّ تَحِيضُ قَالَ لِيَكُنْ آخِرَ عَهْدِهَا الطَّوَافُ بِالْبَيْتِ فَقَالَ الْحَارِثُ كَذَلِكَ أَفْتَانِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ عُمَرُ رَضِيَ اللَّهُ تَعَالَى عَنْهُ أَدَّيْتَ عَنْ يَدَيْكَ سَأَلْتَنِي عَنْ شَيْءٍ سَأَلْتُ عَنْهُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَكِنِّي مَا أُخَالِفُ

Bahz et Affan nous ont rapporté qu'Abu Awanah, d'après Ya'la bin Atha, d'après Al Walid bin Abdurrahman, d'après Al Harits bin Abdullah bin Aus Ats-Tsaqafi, a dit : « J'ai interrogé Umar bin Khattab au sujet d'une femme qui avait accompli le Tawaf à la Kaaba et qui avait ensuite eu ses menstruations. Umar (qu'Allah l'agrée) a dit : « Les femmes qui ont leurs menstruations doivent terminer leur Hajj par le Tawaf à la Kaaba. » Al Harith a dit : « C'est ainsi que le Prophète (que la paix et le salut soient sur lui) m'a donné sa fatwa. » Umar (qu'Allah l'agrée) a dit : « Malheur à toi ! Tu m'as posé une question que j'ai posée au Messager d'Allah (que la paix et le salut soient sur lui), et je n'ai pas contredit cela. »
