حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ قَالَ الرَّجُلُ يَتَزَوَّجُ وَلَا يَفْرِضُ لَهَا يَعْنِي ثُمَّ يَمُوتُ حَدَّثَنَا سَعِيدٌ عَنْ قَتَادَةَ عَنْ خِلَاسٍ وَأَبِي حَسَّانَ الْأَعْرَجِ عَنْ عَبْدِ اللَّهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ أَنَّهُ قَالَ اخْتَلَفُوا إِلَى ابْنِ مَسْعُودٍ فِي ذَلِكَ شَهْرًا أَوْ قَرِيبًا مِنْ ذَلِكَ فَقَالُوا لَا بُدَّ مِنْ أَنْ تَقُولَ فِيهَا قَالَ فَإِنِّي أَقْضِي لَهَا مِثْلَ صَدُقَةِ امْرَأَةٍ مِنْ نِسَائِهَا لَا وَكْسَ وَلَا شَطَطَ وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ فَإِنْ يَكُ صَوَابًا فَمِنْ اللَّهِ عَزَّ وَجَلَّ وَإِنْ يَكُنْ خَطَأً فَمِنِّي وَمِنْ الشَّيْطَانِ وَاللَّهُ عَزَّ وَجَلَّ وَرَسُولُهُ بَرِيئَانِ فَقَامَ رَهْطٌ مِنْ أَشْجَعَ فِيهِمْ الْجَرَّاحُ وَأَبُو سِنَانٍ فَقَالُوا نَشْهَدُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى فِي امْرَأَةٍ مِنَّا يُقَالُ لَهَا بَرْوَعُ بِنْتُ وَاشِقٍ بِمِثْلِ الَّذِي قَضَيْتَ فَفَرِحَ ابْنُ مَسْعُودٍ بِذَلِكَ فَرَحًا شَدِيدًا حِينَ وَافَقَ قَوْلُهُ قَضَاءَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ بَكْرٍ قَالَ قَالَ حَدَّثَنَا سَعِيدٌ قَالَ أَبِي وَقَرَأْتُ عَلَى يَحْيَى بْنِ سَعِيدٍ عَنْ هِشَامٍ عَنْ قَتَادَةَ عَنْ خِلَاسٍ وَعَنْ أَبِي حَسَّانَ عَنْ عَبْدِ اللَّهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ أَنَّ ابْنَ مَسْعُودٍ أُتِيَ فِي امْرَأَةٍ تَزَوَّجَهَا رَجُلٌ فَلَمْ يُسَمِّ لَهَا صَدَاقًا فَمَاتَ قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ فَاخْتَلَفُوا إِلَى ابْنِ مَسْعُودٍ فَذَكَرَ الْحَدِيثَ إِلَّا أَنَّهُ قَالَ كَانَ زَوْجُهَا هِلَالَ أَحْسَبُهُ قَالَ ابْنَ مُرَّةَ قَالَ عَبْدُ الْوَهَّابِ وَكَانَ زَوْجُهَا هِلَالَ بْنَ مُرَّةَ الْأَشْجَعِيَّ حَدَّثَنَا بَهْزٌ وَعَفَّانُ قَالَا حَدَّثَنَا هَمَّامٌ حَدَّثَنَا قَتَادَةُ عَنْ خِلَاسٍ وَأَبِي حَسَّانَ عَنْ عَبْدِ اللَّهِ بْنِ عُتْبَةَ أَنَّهُ اخْتُلِفَ إِلَى ابْنِ مَسْعُودٍ فِي امْرَأَةٍ تَزَوَّجَهَا رَجُلٌ فَمَاتَ فَذَكَرَ الْحَدِيثَ قَالَ فَقَامَ الْجَرَّاحُ وَأَبُو سِنَانٍ فَشَهِدَا أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِهِ فِيهِمْ فِي الْأَشْجَعِ بْنِ رَيْثٍ فِي بَرْوَعَ بِنْتِ وَاشِقٍ الْأَشْجَعِيَّةِ وَكَانَ اسْمُ زَوْجِهَا هِلَالَ بْنَ مَرْوَانَ قَالَ عَفَّانُ قَضَى بِهِ فِيهِمْ فِي الْأَشْجَعِ بْنِ رَيْثٍ فِي بَرْوَعَ بِنْتِ وَاشِقٍ الْأَشْجَعِيَّةِ وَكَانَ زَوْجُهَا هِلَالَ بْنَ مَرْوَانَ

[Muhammad bin Ja'far] Narrated to us that he said: there was a man who married and had not fulfilled his obligations to his wife - meaning because he died too soon -. [Sa'id] Narrated to us from [Qatadah] from [Khilas] and [Abu Hassan Al A'raj] from [Abdullah bin Utbah bin Mas'ud] that he said: So they complained about their dispute to [Ibn Mas'ud] for a month or more or less. They said: "You must issue a fatwa regarding this woman's case!" So Ibn Mas'ud issued his fatwa: "I decide, she must be paid her dowry (mahr) as a woman normally is, the dowry (mahr) cannot be reduced or increased, she has the right to inherit, and she has a period of waiting period (iddah). If my fatwa is correct, it is from Allah 'The Mighty and Majestic, and if it is wrong, it is from me and Satan, Allah and His Messenger disclaim any such fatwa from me. Spontaneously, several people from the Ashja' tribe, including [Aljarrah] and [Abu Sinan] stood up. They said, "We testify that Rasulullah peace and blessings be upon him once decided on a widow of ours named Barwa' bint Watsiq exactly as you decided." At that time, Abdullah bin Mas'ud was happy, because his fatwa was in accordance with the fatwa of Rasulullah peace and blessings be upon him. Narrated to us [Abdullah bin Bakr] he said: said [Sa'id]. My father said, and I read to [Yahya bin Sa'id] from [Hisyam] from [Qatadah] from [Khilas] and from [Abi Hassan] from [Abdullah bin Utbah bin Mas'ud] that [Ibnu Mas'ud] was once asked about the woman the man married, and the man had not mentioned the name of her dowry, then the man died before settling down with his wife. Utbah said, then they complained about their dispute to Ibn Mas'ud, then he mentioned the hadith. Only he said, her husband's name is Hilal, as far as I know she said, his name is Ibn Murrah. While Abdul Wahhab said that her husband's name is Hilal bin Murrah al-Ashja'i. Narrated to us [Bahz] and [Affan] both said: Narrated to us [Hammam] Narrated to us [Qatadah] from [Khilas] and [Abu Hassan] from [Abdullah bin Utbah] that he was complained to [Ibn Mas'ud] about a woman who married a man and then died, and he mentioned the hadith. Utbah said, then Aljarrah and Abu Sinan stood and testified that the Prophet peace and blessings be upon him decided the case as the case that had happened to them, namely the case that had been brought by Asyaja' bin Raith about Barwa' bint Wasyiq al-Ashja'iyah. Barwa's husband's name was Hilal bin Marwan. Marwan said that the Prophet Muhammad decided Utbah's case in the same way that had happened to them, specifically, the case that Asyja' bin Raith had complained about regarding Barwa' binti Watsiq al-Asyja'iyah, whose husband was Hilal bin Marwan.
