Hukuman zina: perjaka dengan perawan dicambuk seratus kali dan diasingkan setahun, sedangkan yang sudah menikah dicambuk dan dirajam
Imam Tirmidzi : 1354حَدَّثَنَا قُتَيْبَةُ حَدَّثَنَا هُشَيْمٌ عَنْ مَنْصُورِ بْنِ زَاذَانَ عَنْ الْحَسَنِ عَنْ حِطَّانَ بْنِ عَبْدِ اللَّهِ عَنْ عُبَادَةَ بْنِ الصَّامِتِ قَالَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خُذُوا عَنِّي فَقَدْ جَعَلَ اللَّهُ لَهُنَّ سَبِيلًا الثَّيِّبُ بِالثَّيِّبِ جَلْدُ مِائَةٍ ثُمَّ الرَّجْمُ وَالْبِكْرُ بِالْبِكْرِ جَلْدُ مِائَةٍ وَنَفْيُ سَنَةٍقَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْهُمْ عَلِيُّ بْنُ أَبِي طَالِبٍ وَأُبَيُّ بْنُ كَعْبٍ وَعَبْدُ اللَّهِ بْنُ مَسْعُودٍ وَغَيْرُهُمْ قَالُوا الثَّيِّبُ تُجْلَدُ وَتُرْجَمُ وَإِلَى هَذَا ذَهَبَ بَعْضُ أَهْلِ الْعِلْمِ وَهُوَ قَوْلُ إِسْحَقَ و قَالَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْهُمْ أَبُو بَكْرٍ وَعُمَرُ وَغَيْرُهُمَا الثَّيِّبُ إِنَّمَا عَلَيْهِ الرَّجْمُ وَلَا يُجْلَدُ وَقَدْ رُوِيَ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلُ هَذَا فِي غَيْرِ حَدِيثٍ فِي قِصَّةِ مَاعِزٍ وَغَيْرِهِ أَنَّهُ أَمَرَ بِالرَّجْمِ وَلَمْ يَأْمُرْ أَنْ يُجْلَدَ قَبْلَ أَنْ يُرْجَمَ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَابْنِ الْمُبَارَكِ وَالشَّافِعِيِّ وَأَحْمَدَ
Narrated to us [Qutaibah], narrated to us [Husyaim] from [Manshur bin Zadzan] from [Al Hasan] from [Hiththan bin Abdullah] from [Ubadah bin Ash Shamit], he said: The Messenger of Allah, peace and blessings be upon him, said: 'Take from me indeed, Allah has made a way for them. A married person who commits adultery with a married person receives one hundred lashes and then stoning. A young person who commits adultery with a young person (both unmarried) receives one hundred lashes and exile for a year.' Abu Isa said: This hadith is hasan sahih and is a guiding practice according to some scholars from the companions of the Prophet, peace and blessings be upon him, including Ali bin Abu Thalib, Ubay bin Ka'bin, Abdullah bin Mas'ud, and others. They held that a married person who commits adultery is only stoned without flogging, and it is narrated from the Prophet, peace and blessings be upon him, like this in other hadiths about Ma'iz and others. Indeed, he ordered stoning and did not order flogging before stoning. This hadith is a guiding practice according to some scholars this is the opinion of Sufyan Ats Tsauri, Ibnu Al Mubarak, Asy Syafi'i, and Ahmad.
