حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ وَهَارُونُ بْنُ عَبَّادٍ الْأَزْدِيُّ الْمَعْنَى قَالَا حَدَّثَنَا وَكِيعٌ عَنْ هِشَامٍ عَنْ عُرْوَةَ عَنْ الْمِسْوَرِ بْنِ مَخْرَمَةَأَنَّ عُمَرَ اسْتَشَارَ النَّاسَ فِي إِمْلَاصِ الْمَرْأَةِ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ شَهِدْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى فِيهَا بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ فَقَالَ ائْتِنِي بِمَنْ يَشْهَدُ مَعَكَ فَأَتَاهُ بِمُحَمَّدِ بْنِ مَسْلَمَةَ زَادَ هَارُونُ فَشَهِدَ لَهُ يَعْنِي ضَرْبَ الرَّجُلِ بَطْنَ امْرَأَتِهِقَالَ أَبُو دَاوُد بَلَغَنِي عَنْ أَبِي عُبَيْدٍ إِنَّمَا سُمِّيَ إِمْلَاصًا لِأَنَّ الْمَرْأَةَ تُزْلِقُهُ قَبْلَ وَقْتِ الْوِلَادَةِ وَكَذَلِكَ كُلُّ مَا زَلَقَ مِنْ الْيَدِ وَغَيْرِهِ فَقَدْ مَلِصَ حَدَّثَنَا مُوسَى بْنُ إِسْمَعِيلَ حَدَّثَنَا وُهَيْبٌ عَنْ هِشَامٍ عَنْ أَبِيهِ عَنْ الْمُغِيرَةِ عَنْ عُمَرَ بِمَعْنَاهُ قَالَ أَبُو دَاوُد رَوَاهُ حَمَّادُ بْنُ زَيْدٍ وَحَمَّادُ بْنُ سَلَمَةَ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ أَنَّ عُمَرَ قَالَ

Narrated to us [Utsman bin Abu Syaibah] and [Harun bin Abbad Al Azdi] in meaning, both said narrated to us [Waki'] from [Hisyam] from [Urwah] from [Al Miswar bin Makhramah] said, 'Umar consulted with people about the law of abortion of the fetus in a woman's womb. Then [Al Mughirah bin Syu'bah] said, 'I saw the Messenger of Allah peace and blessings be upon him give a ruling in that matter by freeing a slave male or female.' Umar said, 'Bring me a witness who was with you.' Then Al Mughirah presented [Muhammad bin Maslamah].' [Harun] added, 'Then he gave evidence with the story of a man who hit his wife's stomach.' Abu Dawud said, 'It has reached me from Abu Ubaid that it is called abortion because a woman gives birth (drops by force) before the time of birth.', Narrated to us [Musa bin Isma'il] said, narrated to us [Wuhaib] from [Hisyam] from [his father] from [Al Mughirah] from Umar in meaning. Abu Dawud said, '[Hammad bin Zaid] and [Hammad bin Salamah] narrated it from [Hisyam bin Urwah], from [his father], that Umar said.
