Penangguhan pelaksanaan had sampai waktu yang sesuai
Imam Tirmidzi : 1361حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ الْخَلَّالُ حَدَّثَنَا أَبُو دَاوُدَ الطَّيَالِسِيُّ حَدَّثَنَا زَائِدَةُ بْنُ قُدَامَةَ عَنْ السُّدِّيِّ عَنْ سَعْدِ بْنِ عُبَيْدَةَ عَنْ أَبِي عَبْدِ الرَّحْمَنِ السُّلَمِيِّ قَالَ خَطَبَ عَلِيٌّ فَقَالَيَا أَيُّهَا النَّاسُ أَقِيمُوا الْحُدُودَ عَلَى أَرِقَّائِكُمْ مَنْ أَحْصَنَ مِنْهُمْ وَمَنْ لَمْ يُحْصِنْ وَإِنَّ أَمَةً لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ زَنَتْ فَأَمَرَنِي أَنْ أَجْلِدَهَا فَأَتَيْتُهَا فَإِذَا هِيَ حَدِيثَةُ عَهْدٍ بِنِفَاسٍ فَخَشِيتُ إِنْ أَنَا جَلَدْتُهَا أَنْ أَقْتُلَهَا أَوْ قَالَ تَمُوتَ فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ أَحْسَنْتَقَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَالسُّدِّيُّ اسْمُهُ إِسْمَعِيلُ بْنُ عَبْدِ الرَّحْمَنِ وَهُوَ مِنْ التَّابِعِينَ قَدْ سَمِعَ مِنْ أَنَسِ بْنِ مَالِكٍ وَرَأَى حُسَيْنَ بْنَ عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ
Narrated to us [Al Hasan bin Ali Al Khallal], narrated to us [Abu Dawud Ath Thayalisi], narrated to us [Za`idah bin Qudamah] from [As Suddi] from [Sa'd bin Ubaidah] from [Abu Abdurrahman As Sulami], he said: [Ali] gave a sermon and said: 'O people, enforce punishments on your slaves, those who are married and those who are not, for indeed a slave woman of the Messenger of Allah, peace and blessings be upon him, committed adultery, and he ordered me to flog her. I went to her and found she had just completed her postpartum period, and I feared that if I flogged her, I would kill her.' Or he said: 'She would die.' I went to the Messenger of Allah, peace and blessings be upon him, and mentioned that to him. He said: 'You did well.' Abu Isa said: This hadith is hasan sahih. As Suddi is named Isma'il bin Abdurrahman from the tabi'in he heard from Anas bin Malik and saw Husain bin Ali bin Abu Thalib, may Allah be pleased with him.
