Turunnya ketentuan li'an atas pertanyaan seorang suami yang mendapati laki-laki lain bersama istrinya
Imam Tirmidzi : 3102حَدَّثَنَا هَنَّادٌ حَدَّثَنَا عَبْدَةُ بْنُ سُلَيْمَانَ عَنْ عَبْدِ الْمَلِكِ بْنِ أَبِي سُلَيْمَانَ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَالَسُئِلْتُ عَنْ الْمُتَلَاعِنَيْنِ فِي إِمَارَةِ مُصْعَبِ بْنِ الزُّبَيْرِ أَيُفَرَّقُ بَيْنَهُمَا فَمَا دَرَيْتُ مَا أَقُولُ فَقُمْتُ مِنْ مَكَانِي إِلَى مَنْزِلِ عَبْدِ اللَّهِ بْنِ عُمَرَ فَاسْتَأْذَنْتُ عَلَيْهِ فَقِيلَ لِي إِنَّهُ قَائِلٌ فَسَمِعَ كَلَامِي فَقَالَ لِيَ ابْنَ جُبَيْرٍ ادْخُلْ مَا جَاءَ بِكَ إِلَّا حَاجَةٌ قَالَ فَدَخَلْتُ فَإِذَا هُوَ مُفْتَرِشٌ بَرْدَعَةَ رَحْلٍ لَهُ فَقُلْتُ يَا أَبَا عَبْدِ الرَّحْمَنِ الْمُتَلَاعِنَانِ أَيُفَرَّقُ بَيْنَهُمَا فَقَالَ سُبْحَانَ اللَّهِ نَعَمْ إِنَّ أَوَّلَ مَنْ سَأَلَ عَنْ ذَلِكَ فُلَانُ بْنُ فُلَانٍ أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ يَا رَسُولَ اللَّهِ أَرَأَيْتَ لَوْ أَنَّ أَحَدَنَا رَأَى امْرَأَتَهُ عَلَى فَاحِشَةٍ كَيْفَ يَصْنَعُ إِنْ تَكَلَّمَ تَكَلَّمَ بِأَمْرٍ عَظِيمٍ وَإِنْ سَكَتَ سَكَتَ عَلَى أَمْرٍ عَظِيمٍ قَالَ فَسَكَتَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَلَمْ يُجِبْهُ فَلَمَّا كَانَ بَعْدَ ذَلِكَ أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ إِنَّ الَّذِي سَأَلْتُكَ عَنْهُ قَدْ ابْتُلِيتُ بِهِ فَأَنْزَلَ اللَّهُ هَذِهِ الْآيَاتِ فِي سُورَةِ النُّورِ{ وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُنْ لَهُمْ شُهَدَاءُ إِلَّا أَنْفُسُهُمْ }حَتَّى خَتَمَ الْآيَاتِ قَالَ فَدَعَا الرَّجُلَ فَتَلَاهُنَّ عَلَيْهِ وَوَعَظَهُ وَذَكَّرَهُ وَأَخْبَرَهُ أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ فَقَالَ لَا وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا كَذَبْتُ عَلَيْهَا ثُمَّ ثَنَّى بِالْمَرْأَةِ وَوَعَظَهَا وَذَكَّرَهَا وَأَخْبَرَهَا أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ فَقَالَتْ لَا وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا صَدَقَ فَبَدَأَ بِالرَّجُلِ فَشَهِدَ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنْ الصَّادِقِينَ وَالْخَامِسَةَ أَنَّ لَعْنَةَ اللَّهِ عَلَيْهِ إِنْ كَانَ مِنْ الْكَاذِبِينَ ثُمَّ ثَنَّى بِالْمَرْأَةِ فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنْ الْكَاذِبِينَ وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنْ الصَّادِقِينَ ثُمَّ فَرَّقَ بَيْنَهُمَاوَفِي الْبَاب عَنْ سَهْلِ بْنِ سَعْدٍ قَالَ وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ
Narrated to us [Hannad] has told us [Abdah bin Sulaiman] from [Abdul Malik bin Abu Sulaiman] from [Sa'ad bin Jubair] who said: I was asked about the husband and wife who swore allegiance during the reign of Mus'ab bin Az Zubair, whether they were separated, I did not know what to say then I got up from my place to the residence of [Abdullah bin Umar], I asked permission to enter. I was told: He is taking his afternoon rest. Ibn Umar heard my words then Ibn Jubair said to me: Please come in, you must have come for something. Sa'ad said: I entered, it turned out he was lying on the saddle of a riding animal. I said: O Abu Abdurrahman, the husband and wife who swore allegiance, are they separated? He replied: SubhaanAllah, of course yes. The first person who asked about it was so-and-so bin so-and-so. He came to the Prophet (peace and blessings of Allah be upon him) and said: O Messenger of Allah, what do you think, if one of us sees his wife committing adultery, what should he do? When he speaks, he brings up a serious matter, but when he remains silent, he also keeps silent about a serious matter. The Prophet (peace and blessings of Allah be upon him) remained silent and did not answer. After that, he came to the Prophet (peace and blessings of Allah be upon him) and said: The matter I asked about happened to me. Then Allah revealed the verses in Surah An-Nur: "And those who accuse their wives (of adultery), while they have no witnesses except themselves." (An-Nur: 6) until the end of these verses. Ibn Umar said: He called the man, recited the verses to him, advised him, reminded him and told him that the punishment of this world is lighter than the punishment of the Hereafter. The man said: By the One Who sent you with the truth, I do not lie about it. After that, the Prophet (peace and blessings of Allah be upon him) repeated the same thing to his wife, advising, reminding, and telling her that the punishment of this world is lighter than the punishment of the Hereafter. His wife said: No, by the One who sent him with the truth, he is not telling the truth. Then the Prophet (peace and blessings of Allah be upon him) started with the man, and he testified four times in the name of Allah that he was telling the truth, and the fifth time that Allah's curse would be upon him if he were lying. After that, his wife continued, and she testified four times in the name of Allah that she was telling the truth, and the fifth time that Allah's punishment would be upon him if he were telling the truth. After that, the Prophet (peace and blessings of Allah be upon him) separated the two. In this case, there is a similar hadith from Sahl bin Sa'id. Abu Isa said: This hadith is hasan sahih.
