Pernikahan budak tanpa izin tuannya adalah zina
Imam Tirmidzi : 1029حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ أَخْبَرَنَا الْوَلِيدُ بْنُ مُسْلِمٍ عَنْ زُهَيْرِ بْنِ مُحَمَّدٍ عَنْ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِعَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ أَيُّمَا عَبْدٍ تَزَوَّجَ بِغَيْرِ إِذْنِ سَيِّدِهِ فَهُوَ عَاهِرٌقَالَ وَفِي الْبَاب عَنْ ابْنِ عُمَرَ قَالَ أَبُو عِيسَى حَدِيثُ جَابِرٍ حَدِيثٌ حَسَنٌ وَرَوَى بَعْضُهُمْ هَذَا الْحَدِيثَ عَنْ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ عَنْ ابْنِ عُمَرَ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَا يَصِحُّ وَالصَّحِيحُ عَنْ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ عَنْ جَابِرٍ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ أَنَّ نِكَاحَ الْعَبْدِ بِغَيْرِ إِذْنِ سَيِّدِهِ لَا يَجُوزُ وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَقَ وَغَيْرِهِمَا بِلَا اخْتِلَافٍ
Narrated to us [Ali bin Hujr], informed us [Al Walid bin Muslim] from [Zuhair bin Muhammad] from [Abdullah bin Muhammad bin 'Aqil] from [Jabir bin Abdullah] from the Prophet, peace and blessings be upon him, who said: 'Any slave who marries without his master's permission is an adulterer.' (Abu Isa At Tirmidzi) said: 'A hadith with similar meaning is narrated from Ibnu Umar.' Abu Isa said: 'A hadith with similar meaning to the hadith of Jabir, and it is a hasan hadith. Some hold that this hadith is from [Abdullah bin Muhammad bin 'Aqil] from [Ibnu Umar] from the Prophet, peace and blessings be upon him, but this is not sahih. The sahih is from Abdullah bin Muhammad bin 'Aqil from Jabir. This is practiced by the scholars among the companions of the Prophet, peace and blessings be upon him, and others: a slave's marriage without his master's permission is invalid. This is the opinion of Ahmad, Ishaq, and others, without disagreement.'
