Anak yang diakui sebagai anak zina dapat mewarisi
Imam Darimi : 2977حَدَّثَنَا عَبْدُ اللَّهِ بْنُ صَالِحٍ حَدَّثَنِي بَكْرُ بْنُ مُضَرَ عَنْ عَمْرٍو يَعْنِي ابْنَ الْحَارِثِ عَنْ بُكَيْرٍ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ قَالَ أَيُّمَا رَجُلٍ أَتَى إِلَى غُلَامٍ يَزْعُمُ أَنَّهُ ابْنٌ لَهُ وَأَنَّهُ زَنَى بِأُمِّهِ وَلَمْ يَدَّعِ ذَلِكَ الْغُلَامَ أَحَدٌ فَهُوَ يَرِثُهُ قَالَ بُكَيْرٌ وَسَأَلْتُ عُرْوَةَ عَنْ ذَلِكَ فَقَالَ مِثْلَ قَوْلِ سُلَيْمَانَ بْنِ يَسَارٍ وَقَالَ عُرْوَةُ بَلَغَنَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ
Narrated to us [Abdullah bin Salih] Narrated to me [Bakr bin Mudlar] from [Amru] namely Ibn Al Harith, from [Bukair] from [Sulaiman bin Yasar] he said:Whoever comes to a child and admits that he is his child and admits that he has committed adultery with his mother, while no one else claims that the child is his own, then the child can inherit it. Bukair said:I once asked [Urwah] about it. So he answered as Sulaiman bin Yasar said. Urwah also said:News has come to us that the Prophet Peace be upon him said: "Children belong to the owner of the mattress (wife) and (the retribution) for a man who commits adultery is a stone (stoning).
