Tidak boleh seorang laki-laki meminang wanita yang telah dipinang oleh saudaranya, hingga saudaranya mengizinkan

حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ وَقُتَيْبَةُ قَالَا حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ الزُّهْرِيِّ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ عَنْ أَبِي هُرَيْرَةَ قَالَ قُتَيْبَةُ يَبْلُغُ بِهِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَقَالَ أَحْمَدُقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَا يَبِيعُ الرَّجُلُ عَلَى بَيْعِ أَخِيهِ وَلَا يَخْطُبُ عَلَى خِطْبَةِ أَخِيهِقَالَ وَفِي الْبَاب عَنْ سَمُرَةَ وَابْنِ عُمَرَ قَالَ أَبُو عِيسَى حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ قَالَ مَالِكُ بْنُ أَنَسٍ إِنَّمَا مَعْنَى كَرَاهِيَةِ أَنْ يَخْطُبَ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ إِذَا خَطَبَ الرَّجُلُ الْمَرْأَةَ فَرَضِيَتْ بِهِ فَلَيْسَ لِأَحَدٍ أَنْ يَخْطُبَ عَلَى خِطْبَتِهِ و قَالَ الشَّافِعِيُّ مَعْنَى هَذَا الْحَدِيثِ لَا يَخْطُبُ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ هَذَا عِنْدَنَا إِذَا خَطَبَ الرَّجُلُ الْمَرْأَةَ فَرَضِيَتْ بِهِ وَرَكَنَتْ إِلَيْهِ فَلَيْسَ لِأَحَدٍ أَنْ يَخْطُبَ عَلَى خِطْبَتِهِ فَأَمَّا قَبْلَ أَنْ يَعْلَمَ رِضَاهَا أَوْ رُكُونَهَا إِلَيْهِ فَلَا بَأْسَ أَنْ يَخْطُبَهَا وَالْحُجَّةُ فِي ذَلِكَ حَدِيثُ فَاطِمَةَ بِنْتِ قَيْسٍ حَيْثُ جَاءَتْ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَتْ لَهُ أَنَّ أَبَا جَهْمِ بْنَ حُذَيْفَةَ وَمُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ خَطَبَاهَا فَقَالَ أَمَّا أَبُو جَهْمٍ فَرَجُلٌ لَا يَرْفَعُ عَصَاهُ عَنْ النِّسَاءِ وَأَمَّا مُعَاوِيَةُ فَصُعْلُوكٌ لَا مَالَ لَهُ وَلَكِنْ انْكِحِي أُسَامَةَ فَمَعْنَى هَذَا الْحَدِيثِ عِنْدَنَا وَاللَّهُ أَعْلَمُ أَنَّ فَاطِمَةَ لَمْ تُخْبِرْهُ بِرِضَاهَا بِوَاحِدٍ مِنْهُمَا وَلَوْ أَخْبَرَتْهُ لَمْ يُشِرْ عَلَيْهَا بِغَيْرِ الَّذِي ذَكَرَتْ

Narrated to us [Ahmad bin Mani'] and [Qutaibah], they said: Narrated to us [Sufyan bin 'Uyainah] from [Az Zuhri] from [Sa'id bin Musayyab] from [Abu Hurairah]. [Qutaibah] said: reaching him from the Prophet, peace and blessings be upon him. Ahmad said: The Messenger of Allah, peace and blessings be upon him, said: 'No one should sell over another's sale, and no one should propose over his brother's proposal.' (Abu Isa At Tirmidzi) said: 'A hadith with similar meaning is narrated from Samurah and Ibnu Umar.' Abu Isa said: 'The hadith of Abu Hurairah is a hasan sahih hadith.' Malik bin Anas said: 'Its meaning is the dislike of a man proposing over his brother's proposal. If the woman consents, no one else may propose to her.' Syafi'i said: 'The meaning of this hadith: a man should not propose over his brother's proposal. In our view, if the woman consents and inclines, no one may propose to her. Before knowing her consent or inclination, it is permissible to propose. Evidence is the hadith of Fathimah binti Qais when she came to the Prophet, peace and blessings be upon him, mentioning that Abu Jahm bin Hudzaifah and Mu'awiyah bin Abu Sufyan proposed to her. (The Messenger of Allah, peace and blessings be upon him) said: Abu Jahm does not lower his staff from women, while Mu'awiyah is poor without wealth marry Usamah." The meaning of this hadith in our view, and Allah knows best: Fathimah had not yet responded to either. If she had informed him, he would not have directed to someone else.'"
