Pena diangkat dari tiga golongan
Imam Ahmad : 1122حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ حَدَّثَنَا سَعِيدٌ عَنْ قَتَادَةَ عَنِ الْحَسَنِ أَنَّ عُمَرَ بْنَ الْخَطَّابِ أَرَادَ أَنْ يَرْجُمَ مَجْنُونَةً فَقَالَ لَهُ عَلِيٌّ مَا لَكَ ذَلِكَ قَالَ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنْ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنْ الطِّفْلِ حَتَّى يَحْتَلِمَ وَعَنْ الْمَجْنُونِ حَتَّى يَبْرَأَ أَوْ يَعْقِلَ فَأَدْرَأَ عَنْهَا عُمَرُ رَضِيَ اللَّهُ عَنْهُ
Narrated to us [Muhammad bin Ja'far] from [Sa'id] from [Qatadah] from [Al Hasan] that Umar bin Khattab intended to stone a mad woman. Ali asked him: Why do you intend to do that? I heard the Messenger of Allah (peace and blessings of Allah be upon him) say: "The pen is not a sin for three people: a sleeping person until he wakes up, a child until he sees a dream, and a madman until he comes to his senses or becomes wise." So Umar left him.
