Penjual dan pembeli berhak memilih meneruskan atau membatalkan akad selama keduanya belum berpisah (khiyar majlis)

حَدَّثَنَا قُتَيْبَةُ حَدَّثَنَا اللَّيْثُ عَنْ نَافِعٍ عَنْ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَاعَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ إِذَا تَبَايَعَ الرَّجُلَانِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا وَكَانَا جَمِيعًا أَوْ يُخَيِّرُ أَحَدُهُمَا الْآخَرَ فَتَبَايَعَا عَلَى ذَلِكَ فَقَدْ وَجَبَ الْبَيْعُ وَإِنْ تَفَرَّقَا بَعْدَ أَنْ يَتَبَايَعَا وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ فَقَدْ وَجَبَ الْبَيْعُ

Narrated to us Qutaibah, narrated to us Al Laits from Nafi, from Ibn 'Umar (may Allah be pleased with them) from the Messenger of Allah (peace be upon him) that he said: 'When two men conduct a sale, each has the option as long as they have not parted and are together, or one gives the other the choice. If they conduct the sale on that basis, the sale is binding. If they part after conducting the sale and neither has canceled it, the sale is binding.'
