Hukum pelaku zina (budak): cambuk tanpa hinaan, jika berulang, jual meski harga sedikit
Imam Abu Dawud : 3876حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ عَنْ مَالِكٍ عَنْ ابْنِ شِهَابٍ عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّأَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سُئِلَ عَنْ الْأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصَنْ قَالَ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍقَالَ ابْنُ شِهَابٍ لَا أَدْرِي فِي الثَّالِثَةِ أَوْ الرَّابِعَةِ وَالضَّفِيرُ الْحَبْلُ
Narrated to us by [Abdullah bin Maslamah] from [Malik] from [Ibnu Syihab] from [Ubaidullah bin Abdullah bin Utbah] from [Abu Hurairah] and [Zaid bin Khalid Al Juhani] that the Messenger of Allah, peace be upon him, was asked about a female slave who committed adultery, but she was not married. He answered: If she commits adultery, then flog her if she commits adultery again, then flog her if she commits adultery again, then flog her then if she commits adultery again, sell her even if for the price of a hair tie. Ibnu Syihab said: I do not know whether it applies on the third or fourth time. While Adh Dhafir is a hair rope.
