Mukmin tidak mewarisi kafir, dan kafir tidak mewarisi mukmin
Imam Tirmidzi : 2033حَدَّثَنَا سَعِيدُ بْنُ عَبْدِ الرَّحْمَنِ الْمَخْزُومِيُّ وَغَيْرُ وَاحِدٍ قَالُوا حَدَّثَنَا سُفْيَانُ عَنْ الزُّهْرِيِّ ح و حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ أَخْبَرَنَا هُشَيْمٌ عَنْ الزُّهْرِيِّ عَنْ عَلِيِّ بْنِ حُسَيْنٍ عَنْ عَمْرِو بْنِ عُثْمَانَ عَنْ أُسَامَةَ بْنِ زَيْدٍأَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَحَدَّثَنَا ابْنُ أَبِي عُمَرَ حَدَّثَنَا سُفْيَانُ حَدَّثَنَا الزُّهْرِيُّ نَحْوَهُ قَالَ أَبُو عِيسَى وَفِي الْبَاب عَنْ جَابِرٍ وَعَبْدِ اللَّهِ بْنِ عَمْرٍو وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ هَكَذَا رَوَاهُ مَعْمَرٌ وَغَيْرُ وَاحِدٍ عَنْ الزُّهْرِيِّ نَحْوَ هَذَا وَرَوَى مَالِكٌ عَنْ الزُّهْرِيِّ عَنْ عَلِيِّ بْنِ حُسَيْنٍ عَنْ عُمَرَ بْنِ عُثْمَانَ عَنْ أُسَامَةَ بْنِ زَيْدٍ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَهُ وَحَدِيثُ مَالِكٍ وَهْمٌ وَهِمَ فِيهِ مَالِكٌ وَقَدْ رَوَاهُ بَعْضُهُمْ عَنْ مَالِكٍ فَقَالَ عَنْ عَمْرِو بْنِ عُثْمَانَ وَأَكْثَرُ أَصْحَابِ مَالِكٍ قَالُوا عَنْ مَالِكٍ عَنْ عُمَرَ بْنِ عُثْمَانَ وَعَمْرُو بْنُ عُثْمَانَ بْنِ عَفَّانَ هُوَ مَشْهُورٌ مِنْ وَلَدِ عُثْمَانَ وَلَا يُعْرَفُ عُمَرُ بْنُ عُثْمَانَ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ أَهْلِ الْعِلْمِ وَاخْتَلَفَ بَعْضُ أَهْلِ الْعِلْمِ فِي مِيرَاثِ الْمُرْتَدِّ فَجَعَلَ أَكْثَرُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ الْمَالَ لِوَرَثَتِهِ مِنْ الْمُسْلِمِينَ و قَالَ بَعْضُهُمْ لَا يَرِثُهُ وَرَثَتُهُ مِنْ الْمُسْلِمِينَ وَاحْتَجُّوا بِحَدِيثِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَهُوَ قَوْلُ الشَّافِعِيِّ
Narrated to us [Sa'id bin 'Abdurrahman Al Makhzumi] and more than one person, they said : has told us [Sufyan] from [Az Zuhri] -In another narration- And has told us ['Ali bin Hujr] has informed us [Husyaim] from [Az Zuhri] from ['Ali bin Husain] from ['Amr bin 'Uthman] from [Usamah bin Zaid] that the Messenger of Allah peace be upon him said: "A Muslim cannot inherit a disbeliever, nor can an unbeliever inherit a believer." Narrated to us [Ibn Abu 'Umar] has told us [Sufyan] has told us [Az Zuhri] with a hadith like this. Abu Isa said : The meaningful hadith was also narrated from Jabir and Abdullah bin Amr. And this hadith is Hasan Sahih. This is also what was narrated by [Ma'mar] and more than one narrator from Az Zuhri. And [Malik] also narrated it from [Az Zuhri] from [Ali ibn Husayn] from [Umar ibn Uthman] from [Usamah ibn Zaid] from the Prophet peace be upon him , with similar hadiths. In Malik's hadith there is Wahm. This hadith has been narrated by some of them from Malik who said: From Amr ibn Uthman. Most of Malik's companions said: From Malik from Amr ibn Uthman. While Amr ibn Uthman is better known as one of Uthman's sons and not known by the name Umar ibn Uthman. According to scholars, this hadith is practiced. While some others have different opinions regarding the inheritance of an apostate. Therefore, most of the companions of the Prophet peace be upon him made the property for his Muslim heirs. And some of them said, "His heirs who are Muslims, cannot inherit his inheritance." And they argue with the hadith of the Prophet peace be upon him , "A Muslim cannot inherit from an infidel." This is the opinion of Imam Asy Syafi'i.
