حَدَّثَنَا الْأَنْصَارِيُّ حَدَّثَنَا مَعْنٌ حَدَّثَنَا مَالِكٌ عَنْ ابْنِ شِهَابٍ عَنْ أَبِي سَلَمَةَ عَنْ جَابِرٍأَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ أَيُّمَا رَجُلٍ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَإِنَّهَا لِلَّذِي يُعْطَاهَا لَا تَرْجِعُ إِلَى الَّذِي أَعْطَاهَا لِأَنَّهُ أَعْطَى عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُقَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَهَكَذَا رَوَى مَعْمَرٌ وَغَيْرُ وَاحِدٍ عَنْ الزُّهْرِيِّ مِثْلَ رِوَايَةِ مَالِكٍ وَرَوَى بَعْضُهُمْ عَنْ الزُّهْرِيِّ وَلَمْ يَذْكُرْ فِيهِ وَلِعَقِبِهِ وَرُوِيَ هَذَا الْحَدِيثُ مِنْ غَيْرِ وَجْهٍ عَنْ جَابِرٍ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ الْعُمْرَى جَائِزَةٌ لِأَهْلِهَا وَلَيْسَ فِيهَا لِعَقِبِهِ وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ قَالُوا إِذَا قَالَ هِيَ لَكَ حَيَاتَكَ وَلِعَقِبِكَ فَإِنَّهَا لِمَنْ أُعْمِرَهَا لَا تَرْجِعُ إِلَى الْأَوَّلِ وَإِذَا لَمْ يَقُلْ لِعَقِبِكَ فَهِيَ رَاجِعَةٌ إِلَى الْأَوَّلِ إِذَا مَاتَ الْمُعْمَرُ وَهُوَ قَوْلُ مَالِكِ بْنِ أَنَسٍ وَالشَّافِعِيِّ وَرُوِيَ مِنْ غَيْرِ وَجْهٍ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ الْعُمْرَى جَائِزَةٌ لِأَهْلِهَا وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ قَالُوا إِذَا مَاتَ الْمُعْمَرُ فَهُوَ لِوَرَثَتِهِ وَإِنْ لَمْ تُجْعَلْ لِعَقِبِهِ وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَأَحْمَدَ وَإِسْحَقَ

Narrated to us [Al Anshari], narrated to us [Ma'n], narrated to us [Malik] from [Ibnu Syihab] from [Abu Salamah] from [Jabir] that the Prophet, peace and blessings be upon him, said: Whoever is given land for him and his descendants, the gift is for the recipient, not returning to the giver, for he gave a gift including his heirs." Abu Isa said: This hadith is hasan sahih thus [Ma'mar] and many narrated from [Az Zuhri] like [Malik]. Some narrated from Az Zuhri but did not mention "wa li'aqabihi." This hadith is also narrated through another chain from Jabir from the Prophet, peace and blessings be upon him: "Umra may be given to the family but not descendants." This hadith is hasan sahih and acted upon by some scholars they held: If the giver says: This gift is for you in life and your descendants, it is for the recipient, not returning. But if no mention of descendants, it returns if the recipient dies this is Malik bin Anas's and Asy Syafi'i's opinion. And narrated through another chain from the Prophet, peace and blessings be upon him: "Umra may be given to his family." This hadith is acted upon by some they held: If the recipient dies, the gift goes to his heirs if none, to descendants this is Sufyan Ats Tsauri's, Ahmad's, and Ishaq's opinion."
