Larangan menyewakan sawah akibat unsur ketidakpastian (gharar)
Imam Nasa'i : 3807أَخْبَرَنَا عَلِيُّ بْنُ حُجْرٍ قَالَ أَنْبَأَنَا عُبَيْدُ اللَّهِ يَعْنِي ابْنَ عَمْرٍو عَنْ عَبْدِ الْكَرِيمِ عَنْ مُجَاهِدٍ قَالَ أَخَذْتُ بِيَدِ طَاوُسٍ حَتَّى أَدْخَلْتُهُ عَلَى ابْنِ رَافِعِ بْنِ خَدِيجٍ فَحَدَّثَهُ عَنْ أَبِيهِعَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ نَهَى عَنْ كِرَاءِ الْأَرْضِفَأَبَى طَاوُسٌ فَقَالَ سَمِعْتُ ابْنَ عَبَّاسٍ لَا يَرَى بِذَلِكَ بَأْسًا وَرَوَاهُ أَبُو عَوَانَةَ عَنْ أَبِي حَصِينٍ عَنْ مُجَاهِدٍ قَالَ قَالَ عَنْ رَافِعٍ مُرْسَلًا
Narrated to us [Ali bin Hujr] Narrated to us ['Ubaidullah i.e. Ibn 'Amr] from [Abdul Karim] from [Mujahid], he said : "I took Thawus' hand until I took him with [the son of Rafi' bin Khadij], then he told him from [his father] from the Messenger of Allah peace be upon him that he forbade renting out land. Then Thawus refused and said : "I have heard Ibn Abbas that he saw no harm in that." And this hadith was narrated by Abu 'Awanah from Abu Hashin from Mujahid, he said : Rafi' said....in mursal."
