Ketika seorang wanita dari suku Makhzum mencuri, Nabi menegakkan hukum dengan memotong tangannya tanpa pandang bulu
Imam Abu Dawud : 3802حَدَّثَنَا يَزِيدُ بْنُ خَالِدِ بْنِ عَبْدِ اللَّهِ بْنِ مَوْهَبٍ الْهَمْدَانِيُّ قَالَ حَدَّثَنِي ح و حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ الثَّقَفِيُّ حَدَّثَنَا اللَّيْثُ عَنْ ابْنِ شِهَابٍ عَنْ عُرْوَةَ عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَاأَنَّ قُرَيْشًا أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ فَقَالُوا مَنْ يُكَلِّمُ فِيهَا يَعْنِي رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالُوا وَمَنْ يَجْتَرِئُ إِلَّا أُسَامَةُ بْنُ زَيْدٍ حِبُّ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَكَلَّمَهُ أُسَامَةُ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَا أُسَامَةُ أَتَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ ثُمَّ قَامَ فَاخْتَطَبَ فَقَالَ إِنَّمَا هَلَكَ الَّذِينَ مِنْ قَبْلِكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمْ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهِمْ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ وَايْمُ اللَّهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَاحَدَّثَنَا عَبَّاسُ بْنُ عَبْدِ الْعَظِيمِ ومُحَمَّدُ بْنُ يَحْيَى قَالَا حَدَّثَنَا عَبْدُ الرَّزَّاقِ أَخْبَرَنَا مَعْمَرٌ عَنْ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ كَانَتْ امْرَأَةٌ مَخْزُومِيَّةٌ تَسْتَعِيرُ الْمَتَاعَ وَتَجْحَدُهُ فَأَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِقَطْعِ يَدِهَا وَقَصَّ نَحْوَ حَدِيثِ اللَّيْثِ قَالَ فَقَطَعَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَدَهَا قَالَ أَبُو دَاوُد رَوَى ابْنُ وَهْبٍ هَذَا الْحَدِيثَ عَنْ يُونُسَ عَنْ الزُّهْرِيِّ وَقَالَ فِيهِ كَمَا قَالَ اللَّيْثُ إِنَّ امْرَأَةً سَرَقَتْ فِي عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي غَزْوَةِ الْفَتْحِ وَرَوَاهُ اللَّيْثُ عَنْ يُونُسَ عَنْ ابْنِ شِهَابٍ بِإِسْنَادِهِ فَقَالَ اسْتَعَارَتْ امْرَأَةٌ وَرَوَى مَسْعُودُ بْنُ الْأَسْوَدِ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَ هَذَا الْخَبَرِ قَالَ سَرَقَتْ قَطِيفَةً مِنْ بَيْتِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَرَوَاهُ أَبُو الزُّبَيْرِ عَنْ جَابِرٍ أَنَّ امْرَأَةً سَرَقَتْ فَعَاذَتْ بِزَيْنَبَ بِنْتِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ
Narrated to us [Yazid bin Khalid bin Mauhab Al Hambdani], he said, narrated to me. (In another chain) Narrated to us [Qutaibah bin Sa'id Ats Tsaqafi], he said, narrated to us [Al Laith] from [Ibnu Syihab] from [Urwah] from ['Aisyah], may Allah be pleased with her, she said, "The Quraysh were shocked by a theft case involving a Makhzumiyah woman. People said, 'Who will seek amnesty for her from the Messenger of Allah, peace and blessings be upon him?' Others replied, 'None dare do so except Usamah bin Zaid, the beloved of the Messenger of Allah, peace and blessings be upon him.' Usamah then conveyed it to the Messenger of Allah, peace and blessings be upon him, who said: 'O Usamah! Would you seek leniency in Allah’s hudud law?' He stood and delivered a sermon: 'Indeed, those before you perished because if a noble among them stole, they spared him the penalty, but if a lowly person stole, they enforced the penalty. By Allah, if Fatimah, daughter of Muhammad, stole, I would surely cut off her hand.'" Narrated to us [Abbas bin Abdul Azhim] and [Muhammad bin Yahya], both said, narrated to us [Abdurrazaq], he said, informed us [Ma'mar] from [Az Zuhri] from [Urwah] from ['Aisyah], may Allah be pleased with her, she said, "A Makhzumiyah woman borrowed items, then denied borrowing them. The Prophet, peace and blessings be upon him, ordered her hand be cut off. Then she narrated as in Al Laith’s hadith." The narrator said, "The Prophet, peace and blessings be upon him, then cut off her hand." Abu Dawud said, "[Ibnu Wahb] narrated this hadith from [Yunus], from [Az Zuhri], in it he mentioned as Al Laith did, 'A woman stole during the Prophet’s time, peace and blessings be upon him, at the conquest of Mecca.' [Al Laith] also narrated it from [Yunus], from [Ibnu Syihab] with his chain, saying, 'A woman borrowed...' Mas'ud Ibnul Aswad also narrated from the Prophet, peace and blessings be upon him, like the hadith, saying, 'The woman stole velvet cloth from the house of the Messenger of Allah, peace and blessings be upon him.' And [Abu Az Zubair] narrated it from [Jabir], 'Indeed, a woman stole, then sought refuge with Zainab, daughter of the Messenger of Allah, peace and blessings be upon him.'"
